A client approached us with a request to renew his work KITAS, initially processed a year ago through another agent. He entrusted us with the management of his company’s reports, expecting the renewal process to be smooth and hassle-free. However, the reality turned out to be far more complex and filled with unexpected challenges.
Preparing for Renewal: Step by Step
First, we requested all the necessary KITAS information, company documents, and access to electronic systems from the client. Several mandatory requirements had to be met for the renewal: the foreign employee needed a personal NPWP, SKTT, BPJS Health registration, and submission of his personal annual tax report.
On the company’s side, there were also numerous requirements. At the time of renewal, we had to confirm the presence of local employees, present an updated employment report, submit the annual report, and ensure all employees were registered with BPJS Employment.
Understanding the time and meticulous preparation required, we began the process well in advance to avoid potential issues. The preparation included collecting and processing the foreign employee’s personal data, NPWP, SKTT, and submitting his personal annual report. Everything seemed manageable until we encountered unforeseen obstacles.
Unexpected Difficulties
Initially, everything proceeded as planned; we received the local employees’ documents from the client. However, difficulties arose when it came to updating the employment report and gaining access to electronic systems.
For the KITAS renewal, we needed access to several key systems:
- OSS (Online Single Submission)
- Visa Online
- Djp online (Directorate General of Taxes online)
- BPJS Employment (Badan Penyelenggara Jaminan Sosial)
- TKA (Tenaga Kerja Asing, system for issuing RPTKA – work permits for foreign workers)
- Wajib Lapor Ketenagakerjaan (system for submitting and updating the company’s employment report)
We had no problems accessing the first three systems. For BPJS Employment, we created the company account during the registration of the foreign employee and local workers. However, the previous agent outright refused to transfer access to the TKA and Wajib Lapor systems. In response to our requests, he simply advised us to “send an email to the Ministry of Labor.”
Realizing that collaboration with this agent was impossible and that he was unlawfully withholding company data, we decided to act directly through the Ministry of Labor.
Battling for Access and Unexpected Discoveries
We managed to restore access to TKA, allowing us to apply for the work permit renewal. But with Wajib Lapor, we faced serious issues. Even after regaining access, logging into the company account and updating the information was difficult. It seemed someone was continually changing the password, hindering our work.
Without an updated employment report, renewing the work KITAS was impossible. The agent refused to provide access, update the report, or delegate the task to us. Why? When we finally logged into the Wajib Lapor system, we discovered the reason.
Shocking Discoveries in the Company Account
In the system, we found two major issues:
- Incorrect BPJS Employment Linkage: The company account was linked to the BPJS Employment of an entirely different company. This meant the employee registration and insurance payments were incorrect.
- Over 100 Employees Listed: The system showed over 100 employees, far exceeding the actual number. This posed significant risks of hefty fines for unregistered employees in BPJS and unpaid insurance contributions, not to mention potential tax penalties.
Our client was unaware of all this. The agent likely withheld access due to these hidden problems. The situation demanded immediate resolution.
A New Plan and Successful Completion
We decided to create a new account for the client’s company. Using the current employees’ data, we managed to register a new account, submit the employment report, and apply for the KITAS renewal.
The fate of the old account remains uncertain, but the crucial point is that the client received his KITAS renewal, and we uncovered and resolved significant documentation issues for the company.
